Terms and Conditions

The following terms and conditions (“Terms and Conditions”) shall apply to the OSIM The Joy You Knead Christmas Lucky Draw.

1. General

1.1. The OSIM The Joy You Knead Christmas Lucky Draw (“Promotion”) is organized by OSIM International Pte Ltd (“OSIM”).

1.2. Participation in the Promotion is subject to these Terms and Conditions. By participating in the Promotion, participants (“Participants”) agree to be bound by and to comply with the Terms and Conditions, including any amendments, modifications and variations hereto.

2. Eligibility

2.1. The Promotion is open to all individuals who are aged 18 and above (as at the start of the relevant Qualifying Period) and residing in Singapore and who are Singapore Citizens, Singapore permanent residents, or holders of Dependent Pass, Employment Pass or Work Permit Card.

2.2. The Promotion is not open to:

2.2.1. directors and/or employees of OSIM or any of OSIM’s related corporations, and their immediate family members;

2.2.2. employees and staff of any sponsors, auditors, advertising or promotion agencies for this Promotion and/or any other persons involved in organizing, promoting and/or conducting the Promotion, and their immediate family members; and

2.2.3. persons who are ineligible for the Promotion (as determined by OSIM in its sole and absolute discretion).

2.3. OSIM has the absolute discretion to determine the eligibility of Participants, and OSIM may disqualify any Participant from participating in the Promotion at any time before, during or after the Promotion. Such determination by OSIM shall be final and conclusive and OSIM is not obliged to give any reason for its determination.

2.4. Winners of the Promotion may be required to sign a written statement confirming their eligibility before prize collection. OSIM reserves the right in its sole discretion to withhold delivery of the prize until proof of eligibility and identity has been confirmed or if such proof is not produced on request, to disqualify the Participant from the Promotion.

2.5. If OSIM discovers that any Participant is not eligible to participate in the Promotion, OSIM may at its discretion forfeit the Prizes (or reclaim the same if awarded) or dispose of it in such manner and to such person as OSIM deems fit.

2.6. The Promotion is available at all OSIM retail outlets in Singapore (“OSIM Outlets”) and the OSIM e-store accessible at https://sg.osim.com/ (“OSIM Webshop”).

3. Allocation of Lucky Draw Entries

3.1. For the purposes of these Terms and Conditions, the following definitions shall apply:

3.1.1. “Qualifying Outlet” means any OSIM Outlet or the OSIM Webshop.

3.1.2. “Qualifying Purchase” means any purchase made by the Participant in a single sales order during the Qualifying Period in any Qualifying Outlet, PROVIDED ALWAYS that the transaction for the purchase by the Participant is not subsequently cancelled, voided or reversed for any reason.

3.1.3. “Online Lucky Spin Entries” mean any lucky spin entries that are given to a Participant for the Participant’s Qualifying Purchase(s) on the OSIM Webshop.

3.2. Participants can get lucky draw entries by making Qualifying Purchases.

3.3. Lucky draw entries are subject to availability.

3.4. Lucky draw entries will be awarded by OSIM through the following mechanics:

3.4.1. Each participant will be entitled to one (1) pick per Qualifying Purchase which will be awarded via a physical pick from the Christmas stocking provided in store or a digital lucky spin online.

3.4.4. Customers who make any purchase during the Qualifying Period will be eligible for one (1) pick for a chance to get

3.4.4.1. $10 OSIM Voucher

3.4.4.2. $10 OSIM Voucher + Free Gift Christmas Pen or Cutlery

3.4.4.3. $10 OSIM Voucher + Free Gift Christmas Nano Block

3.4.5. In determining whether a Participant has achieved the required minimum spend, only the net spend amount (after GST) for OSIM product and product-related services as stated on the sales invoice will be considered.

3.4.6. For any Qualifying Purchase that fall under the same categories mentioned in (3.4.2.), (3.4.3.) (3.4.4) but were purchased through the OSIM Webshop, an Online Lucky Spin Entry will be done instead.

3.4.7. Participants will only be entitled to lucky draw entries and/or lucky draw chances for non-voided sales orders for which OSIM has received full payment (except for purchases made via instalment plan).

3.4.8. If a Participant terminates their payment or cancels their sales order, he/she will be disqualified from the Promotion.

3.5. OSIM may also hold giveaways of lucky draw entries during the Qualifying Period that do not require any Qualifying Purchase to be made for participation in the giveaway (“Lucky Draw Giveaways”).

3.6. In respect to lucky draw entries that are given out by OSIM for the Lucky Draw Giveaways, Participants can only receive a maximum of 1 pick entry per household for the entire Promotion, regardless of how many Lucky Draw Giveaways the Participants participate in.

3.7. Each lucky draw entry (except for Online Lucky Spin Entries) will entitle the Participant to one chance to participate in a physical pick from the Christmas stocking provided in store in an OSIM Outlet during the Qualifying Period.

3.8. OSIM maintains the right, at its absolute discretion, to effect any adjustments, forfeitures or disqualification of the pick & win entries and/or pick & win chances allocated to each Participant, with or without notice to the Participant. OSIM’s decision on the number of pick & win entries and/or pick & win chances allocated to the Participant shall be final and binding on all parties concerned. No appeal, correspondence or claims will be entertained.

4. Prizes

4.1. The prizes for the Promotion (“Prizes”) are available while stocks last.

4.3. Participants who win lucky draw chances from the lucky draw can participate in the Lucky Draw Giveaway.

4.4. There is no limit on the number of lucky draw chances that each Participant may receive from the lucky draw prizes. However, every Participant is only eligible to win a total of one (1) prize from the Lucky Draw.

4.5. All lucky draw chances are only valid for the “OSIM The Joy You Knead” lucky draw (“Lucky Draw”).

4.6. The prizes for the Lucky Draw are:

4.7. All prices and values of the Prizes set out in this Clause 4 (Prizes) or in any advertising, promotional, publicity and other materials are purely indicative and for information purposes only and such prices and values may vary in accordance with market fluctuations and other market conditions. OSIM accepts no liability for any loss howsoever arising from the use of or reliance on such indicative prices and values.

4.8. All prizes are non-transferable, non-refundable and non-exchangeable for cash, credit or any other item. Each prize is subject to any accompanying terms and conditions. OSIM may at its sole discretion at any time substitute or replace any prize with any other prize of a similar value.

5. Lucky Draw

5.1. Participants are required to provide their first name, last name, mobile number and email address to participate in the lucky draw.

5.2. The Lucky Draw will be held at the following location and time:

5.3. OSIM reserves the right to draw reserve winners to replace any winner subsequently found to be ineligible or disqualified.

5.4. One (1) winner will be drawn for the Lucky Draw, and OSIM will notify the winner on the Draw Date by calling him/her on the phone number which they have provided to OSIM.

5.5. If the winner cannot be contacted or the winner fails to respond after a total of five calls made by OSIM within 24 hours from the first call made by OSIM to the winner, the winner will be disqualified from the Lucky Draw and OSIM will select another winner.

6. Qualifying Period

6.1. The qualifying period for the Promotion (“Qualifying Period”) is as follows:

7. Prize Collection

7.1. All free items won from the pick & win must be collected from an OSIM outlet during the Qualifying Period, or else the prizes will be forfeited.

7.2. Lucky draw winner will be issued with a winner’s prize letter for prize redemption.

7.3. The winner’s prize letter will also set out the terms and conditions (if any) and instructions for claiming the prize. OSIM does not assume any liability or responsibility and shall not be liable or responsible for any failure or delay in the receipt of the winner’s prize letter or for any winner’s prize letter which gets lost or misplaced or tampered with or defaced or stolen or misdirected or damaged in the post or which has expired.

7.4. Within 1 month from the date of the winner’s notification letter, the winner must confirm the delivery location and delivery time slot for OSIM to deliver the Prize to the winner. If the winner fails to confirm a delivery location or delivery time slot within the said period, OSIM will not be obliged to deliver the Prize to the winner (if applicable).

7.5. Any lucky draw prize not claimed within 1 month from the date of the winner’s notification letter will be forfeited without any liability on the part of OSIM to the Participant.

7.6. Prize collections made on behalf of a winner will not be accepted unless OSIM has given its prior approval for the same.

8. Collection of Personal Data

8.1. OSIM reserves the right to disclose and publish the name and any other particulars of the winners (including photos, voice recordings or videos of the winners) for publicity purposes and the winners agree to co-operate with and participate in the activities organized by OSIM for these purposes.

8.2. By participating in the Promotion, the Participant is deemed to have consented to the collection, use and disclosure of his/her personal data (“Personal Data”) by OSIM, OSIM’s partners, agencies, promoters and/or their respective contractors for verifying the eligibility of the Participant, conducting the Promotion, (including having the Participant’s photo, voice recordings and video taken/published), and all purposes and promotions incidental to the Promotion.

8.3. By entering into the Promotion:

8.3.1. the Participant agrees to receive information from OSIM, including special offers and/or joint promotions that OSIM may have from time to time via mail/electronic mail/SMS/calls;

8.3.2. the Participant consents for OSIM and any advertising or promotion agencies engaged by OSIM to:

(a) collect the Personal Data submitted by the Participant during the Participant’s participation in the Promotion, including but not limited to the Participant’s first and last name, mobile number and email address; and

(b) collect, use and disclose the Personal Data in accordance with the OSIM Personal Data Protection Policy, available at https://sg.osim.com/policies/.

8.4. Without prejudice to the generality of the foregoing, by participating in the Promotion, the Participant agrees to be contacted via email, SMS, phone call, or other forms of electronic communication with regards to the prizes and his/her participation in the Promotion, by OSIM.

8.5. A Participant who withdraws his/her consent to collection, use and disclosure of his/her personal data under this paragraph 8 (Personal Data) shall be disqualified from the Promotion.

9. General

9.1. The winner shall accept the prize “as is” and agrees and acknowledges that OSIM shall be under no obligation to entertain any request by the winner to change any aspect of the prize.

9.2. OSIM and OSIM’s partners for the Promotion shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death in connection with the Promotion, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

9.3. Except to the extent that they may not be excluded by law, no representations, warranties, terms or conditions that are not expressly stated in these terms and conditions apply to this Promotion nor in respect of the Prizes, and all implied warranties are excluded, including but not limited to, the implied warranties of satisfactory quality, merchantability or fitness for a particular purpose of any of the Prizes.

9.4. OSIM reserves the right to withdraw, discontinue or terminate the Promotion at any time at its absolute discretion, without notice or liability to any person.

9.5. The decision of OSIM on all matters relating to or in connection to the Prizes or eligibility of Participants shall be final and binding on all parties concerned. OSIM shall not be obliged to enter into any correspondence with any person on any matter concerning the Promotion.

9.6. OSIM reserves the right to vary, delete or add to these Terms and Conditions at any time at its absolute discretion without notice or liability to the Participants of the Promotion or any other person.

9.7. In the event of any inconsistency between these Terms and Conditions and any sales order/sales invoice, or any publicity, marketing or promotional material relating to the Promotion, these Terms and Conditions shall prevail to the extent of the inconsistency.

9.8. These Terms and Conditions are governed by the laws of Singapore, and all Participants shall be deemed to have irrevocably agreed to submit to the exclusive jurisdiction of the Singapore Courts.
